National Association of Football Agents in Brazil
This is the the home of the ABAF - Associação Brasileira de Agentes de Futebol. Over 30 years the ABAF is representing and promoting player agents. Created in 1990, it exists to defend, aggregate and value the profession of football agent. The ABAF brings together player agents, with the aim of dignifying the agent profession, monitoring compliance with legislation and defending their interests, both nationally and internationally.
Legal Proceedings on FFAR in Brazil
On 19 December 2023, the Civil Court of Rio de Janeiro suspended the application of the new Football Agents Regulations of the Confederação Brasileira de Futebol(CBF), which had implemented the new FIFA Football Agent Regulations (FFAR). CBF and FIFA were then ordered to refrain from seeking to apply a number of provisions of the FFAR, including those on the caps and multiple representation.
The 7th Civil Court of Barra da Tijuca (Rio de Janeiro), suspended the implementation of a series of articles of the new FIFA Football Agents Regulations (FFAR) on a national level. The Brazilian Football Confederation (CBF) had adopted these regulations in its own set of rules earlier this year. The action was filed by the Brazilian Association of Football Agents (ABAF) and also involved the Administrative Council for Economic Defense (CADE). In the decision, the judge stated that the application of the articles seems to raise well-founded doubts about a possible violation of Brazilian constitutional principles specifically those related to free economic activity and that the obligation imposed by the CBF on football agents to master English, Spanish, and French unnecessarily restricted professional freedom according to Brazilian law and is clearly opposed to the definition of the profession provided for in Article 95 of Law 14,597/2023.
In the end of February 2024, the Civil Court of Rio de Janeiro dismissed the appeals filed by FIFA and the Confederação Brasileira de Futebol(CBF) against the decision on provisional measures granted in favour of the Associação Brasileira de Agentes de Futebol (ABAF). The confirmed decision had suspended several rules issued by the CBF to implement the FFAR.
